Use of the Service, submission of a contact or consultation request form, or receipt of marketing communications does NOT establish a clinical, treatment, or provider-patient relationship. A provider-patient relationship is only established after a clinical intake and consultation conducted by a licensed provider in compliance with applicable laws and regulations.

Information on the Service is general in nature and is not tailored to Your specific health condition, medical history, medications, or treatment needs. Always consult a qualified healthcare provider before starting, stopping, or changing any treatment, medication, supplement, or therapy.

In a medical emergency, call 911 or go to the nearest emergency room. Do not use the Service or SMS messaging to communicate medical emergencies.

Telehealth Services

Telehealth services offered by Body Symmetry MD are provided only to patients located in California at the time of the telehealth visit, in compliance with California law. Establishment of a provider-patient relationship through telehealth requires completion of Our clinical intake process and is at the sole discretion of Our licensed providers.

Telehealth is not appropriate for all conditions or situations. Our providers may decline to provide telehealth services and refer You to in-person care when clinically appropriate.

SMS Communications

By providing Your mobile phone number and checking the SMS consent box on Our forms, You consent to receive transactional text messages from Body Symmetry MD as described in Our Privacy Policy. These messages may include appointment confirmations, reminders, lab result availability notifications, prescription pickup notifications, and follow-up communications tied to an existing patient relationship or inquiry.

SMS messages will not contain specific clinical results, diagnoses, or other Protected Health Information. Notifications regarding clinical matters will direct You to Our secure patient portal or instruct You to call Our office.

Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time.

Accuracy of Information

You agree to provide accurate, current, and complete information when submitting forms, requesting consultations, or otherwise contacting Us. You are responsible for maintaining the accuracy of any information You provide.

User Conduct

You agree not to:

Use the Service for any unlawful purpose

Submit false, misleading, or fraudulent information

Interfere with the operation, security, or integrity of the Service

Attempt to gain unauthorized access to any part of the Service or related systems

Use automated tools (bots, scrapers, crawlers) to access the Service without Our written permission

Send spam or unsolicited communications through any contact channel

Reproduce, copy, or exploit any portion of the Service for commercial purposes without Our express written consent

Submit Protected Health Information through marketing forms (use Our patient portal or call Our office for clinical matters)

Intellectual Property

All content on the Service — including text, images, logos, photographs, graphics, video, audio, and design — is the property of Body Symmetry MD or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any content on the Service without Our prior written permission.

The “Body Symmetry MD” name, logo, and any related trademarks are owned by Us. You may not use them without Our prior written consent.

Pricing, Service Estimates, and Quotes

Any pricing, treatment estimates, or scheduling information provided through the Service or in initial conversations is preliminary and subject to change based on a clinical evaluation, applicable regulations, and the final treatment plan determined by a licensed provider.

Submission of a form on the Service does not constitute a binding agreement for services or guarantee of treatment availability or eligibility.

Testimonials and Results

Patient testimonials and outcome information that may appear on the Service represent individual experiences and are not typical results. Past performance is not a guarantee of future results. Individual outcomes vary based on numerous factors, including biological response, adherence to treatment, lifestyle, and individual medical history.

We do not pay for testimonials. Testimonial providers may have an existing or past patient relationship with Us and have provided express consent for the use of their testimonial.

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.

Termination

We may terminate or suspend Your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Indemnification

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service), even if the Company or any supplier has been advised of the possibility of such damages.

This limitation does not apply to any clinical services or treatment agreements separately executed between You and Body Symmetry MD as part of a provider-patient relationship, which are governed by their own terms and applicable law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Information provided through the Service regarding hormones, men’s health, wellness, supplements, treatments, or any related topic is general in nature and is NOT medical advice. The Service is not a substitute for professional medical evaluation, diagnosis, or treatment. Specific health outcomes from any therapy, including hormone optimization, depend on individual physiology, adherence to treatment, lifestyle, and other factors and cannot be guaranteed.

The Company makes no representation or warranty that any specific result, outcome, or improvement will be achieved by any individual.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company at [email protected]. If We cannot resolve the dispute within 30 days, either party may pursue formal legal remedies in the state or federal courts located in Riverside County, California.

This Terms-based dispute resolution process does not apply to medical malpractice, treatment-related, or other clinical claims, which are governed by separate provider agreements and applicable law.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect.
